got a replacement xpera mini pro today because my last 1 don't have option to upgrade or turn on or of data traffic. now the new 1is the same . could it be because the 1 that dis have the options to do it is sim free and other 1s are tombile contract ? as they both have same software *

Yep,it very well could be. You can just simply go to Android Market, download APNDroid, and use that to turn on/off data. *
